GENERAL INFORMATION ON THE K-1 FIANCEE VISA:

The K-1 Fiancee Visa was designed to make the process of marrying someone from a foreign land simple. At the same time, this Visa also provides the United States Immigration, Naturalization Service (INS) a way of tracking the immigrant. It also ensures that Americans are not being scammed and used as a "free ride" for foreigners to migrate to the United States and become a burden on the US economy. The INS process does work, it just takes time!

CAN YOU FILE THE PAPERWORK YOURSELF?

Of course you can. Some individuals try to go through the nightmare of attempting to file all of the K-1 paperwork without any help or assistance. However, the result can be a costly delay in the process. These delays can encompass such things as:

1. Mistakes on the paperwork
2. Using the wrong form
3. Insufficient forms
4. Improperly filled out
5. Unsigned forms
6. Insufficient data from both you and your fiancée!
7. Improper photographs
8. Package divided into two and not arriving together
9. Insufficient paperwork from the foreigner.
10. You did not meet your fiancée in person.
11. One of you is not free to marry.
12. You did not meet the current poverty guidelines.

Each of these processes can cause a delay from month to three months, depending on the INS workload. These delays can be stressful on a long distance relationship! It is important that the necessary paperwork be filled out correctly, sent as a complete package, and contains all of the required forms as required by the INS. The INS posts updates regularly. If you don't keep up with their updates, it can cost you a great deal of time in getting together with you future mate. If your future relationship is important to you, let someone else complete the paperwork, and we are the most reasonable.

DOES THE INS APPROVE ALL K-1 VISA APPLICATIONS?

No! In fact, this may be shocking to you. 40% of K-1 Visa Applications are not approved! Notice that we said, "Not Approved" and did not use the word "Denied". There is a big difference! Rarely does the INS and US Consulates turn down a fiancée visa petition/application request if ALL the requirements are met!

DO WE BOTH HAVE TO PROVIDE INFORMATION?

Yes! There is a burden on both of you. Each must be truthful and complete the necessary forms with accuracy and/or proof as required. Failure to do so can mean either a delay, turned down or denied.

WHAT ARE SOME OF THE REASONS FOR DENIAL?

The US Consular in the country of your fiancée will review all paperwork. By law, they may turn down applicants who have a communicable disease, or have a dangerous physical or mental disorder; are drug addicts; have committed serious criminal acts, including crimes involving moral turpitude, drug trafficking, and prostitution; are likely to become a burden on the US; have used fraud or other illegal means to enter the United States; or are ineligible for citizenship, must be refused a visa. The two-year foreign residency requirement for former exchange visitors is also applicable. If found to be ineligible, the Consular Officer will advise the applicant if the law provides for a waiver.

WHAT DO THEY MEAN BY FINANCIAL RESPONSIBILITY?

You must be in such a position that you can financially take care of your new spouse and that they do not become a burden of the United States.

(a) Our services begin with an initial phone consultation. During that conversation we will determine the most effective and expediant method of handling your K-1 Fiancee Visa process.
(b) All of the required INS forms will be sent to you so that you may begin the preparation. We will include a list of items that will be needed from both you and your Fiancée to process your petition.
(c) We will call you after you receive your forms. We will go over with you each step to make sure that you provide us with the correct information and coduments that are needed to submit your Fiancée visa petition. In the package to you will will include sample forms for you to follow.
(d) When we have your package back, we will complete the original forms that will need to be submitted to the INS. We will check for information, accuracy, and monitor the latest updates from the INS.If there are any questions we will contact you immediately.
(e) We will translate into English any documents that need to be submitted or are required by the INS.
(f) We will write the cover letter to the INS explaining your relationship, including the circumstances of how you actually met, along with a detailed cover letter describing your petition, and all of its contents.
(g) We will send you a complete copy of your Fiancée Visa package for your records after we submit all of the originals to the INS for processing.
(h) When you receive your approval, we will be available for consultation when needed, and we will explain to you what to expect when your Fiancée goes for their medicat examination and then to their interview at the embassy. We will make every effort to assist you throughout the entire process.
